Terms of Service

These Terms, together with our Privacy Policy, Cookie Policy, and any other policies or rules referenced herein, constitute the entire agreement between you and FreelanceKE regarding your use of the Service. We may revise these Terms at any time by posting the revised version on the Site. Continued use after changes constitutes acceptance of the updated Terms.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

Certain features require registration. You agree to provide accurate, current and complete information during registration and to update it promptly. You are responsible for all activity under your account and for maintaining the confidentiality of your password.

You agree not to: (a) violate any applicable law; (b) infringe any intellectual property or other rights; (c) post fraudulent, misleading or unlawful content; (d) attempt unauthorized access; (e) interfere with the Service or other users. We may suspend or terminate accounts for violations.

Sellers may create gigs and buyers may post jobs. All listings must be accurate. Proposals require Connects. We reserve the right to remove content that violates these Terms or our Community Guidelines.

All payments are processed in Kenyan Shillings (KSh) via M-Pesa or PayPal. We charge a service fee of 10–15% (configurable) on completed orders. Funds are held in escrow until work is approved. Withdrawals have a minimum of KSh 1,000. All users are responsible for their own tax obligations.

We provide an escrow system for secure transactions. In case of disputes, parties should attempt resolution directly. If unresolved, either party may submit a dispute to FreelanceKE for mediation. Our decision is final and binding.

Upon full payment, the buyer receives all rights to the delivered work (unless otherwise agreed). Sellers retain rights to pre-existing materials unless explicitly transferred. Users grant FreelanceKE a limited license to display content on the Site.

We may suspend or terminate your account at any time for violation of these Terms, illegal activity, or at our sole discretion. You may terminate your account at any time by contacting support.

The Service is provided “as is” without warranties of any kind. To the fullest extent permitted by law, FreelanceKE shall not be liable for indirect, incidental, consequential, special or punitive damages arising from use of the Service.

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved exclusively in the courts of Nairobi, Kenya. We encourage informal resolution before litigation.

We may update these Terms from time to time. We will notify users of material changes via email or in-site notice. Continued use after such changes constitutes acceptance.
